End User Licence Agreement

This End User Licence Agreement ("EULA") is a binding legal agreement between you ("Licensee") and Mindspan Pty Ltd ("Licensor"). It governs your use of all materials included in any purchased study program, including HTML pages, PDF documents, audio files, video content, quiz files, clinical frameworks, and any other resources delivered through app.mindspan.com.au ("Licensed Materials").

By completing a purchase, you agree to the terms of this EULA. If you do not agree, do not purchase or access the materials. Contact us at info@mindspan.com.au for a refund within 14 days of purchase.

1. Licence grant

Subject to payment and compliance with this EULA, the Licensor grants you a personal, non-exclusive, non-transferable, revocable licence to:

• Access Licensed Materials through the Mindspan platform for the duration of your access period (12 months from purchase for one-off programs)
• Download PDF versions of Licensed Materials for your own personal offline study
• View and use Licensed Materials on any device owned or controlled by you

No other rights are granted. All rights not expressly granted are reserved by the Licensor.

2. Restrictions

You must not:

• Redistribute Licensed Materials by any means, including email, file sharing, cloud storage accessible to others, or any platform
• Resell or sublicence Licensed Materials or access to them
• Share login credentials to allow others to access Licensed Materials through your account
• Reproduce Licensed Materials in part or whole in any commercial product, course, publication, or training program
• Modify, adapt, translate, or create derivative works from Licensed Materials without written consent from the Licensor
• Upload Licensed Materials to any AI training dataset, knowledge base, or language model fine-tuning process
• Remove or obscure any copyright notice, trademark, watermark, or attribution from Licensed Materials
• Represent Licensed Materials as official guidance from AHPRA, the Psychology Board of Australia, or any accreditation body

3. Ownership and intellectual property

All Licensed Materials are the exclusive intellectual property of Mindspan Pty Ltd and are protected by the Copyright Act 1968 (Cth) and applicable international copyright law. Your purchase does not transfer any ownership interest in the Licensed Materials to you.

Mindspan™ and Mindspan Psychology™ are trademarks of Mindspan Pty Ltd. You may not use these marks in any way without prior written consent.

4. Educational use only

Licensed Materials are educational resources only. They are authored by a registered psychologist for the purpose of exam preparation and professional development. They do not constitute:

• Clinical psychological advice or treatment
• Supervision or professional development hours under AHPRA requirements
• Official guidance from the Psychology Board of Australia, AHPRA, or any accreditation body
• A guarantee of exam success

Licensed Materials are not a substitute for the Psychology Board of Australia's official exam information, which remains the authoritative source for all examination requirements.

5. Downloaded materials

PDFs you download during your access period remain yours after access expires, subject to the restrictions in clause 2. You may retain downloaded PDFs for personal reference indefinitely. The licence restrictions in clause 2 continue to apply to downloaded materials after your access period ends.

6. Termination

This licence terminates automatically and without notice if you breach any term of this EULA. On termination, you must immediately cease all use of Licensed Materials and delete any downloaded copies. The Licensor reserves the right to seek injunctive relief and damages for any breach.

On expiry of your access period, your online access terminates. Downloaded materials may be retained subject to the restrictions above.

7. Disclaimer and limitation of liability

Licensed Materials are provided in good faith and reflect the clinical knowledge of the authoring psychologist at time of publication. The Licensor does not warrant that materials are complete, error-free, or current with any specific version of any diagnostic manual or examination framework.

To the maximum extent permitted by law, the Licensor's total liability under this EULA is limited to the amount paid for the relevant program. Nothing excludes liability for fraud, personal injury caused by negligence, or rights under the Australian Consumer Law.

8. Governing law

This EULA is governed by the laws of Victoria, Australia. Any dispute arising under this EULA is subject to the exclusive jurisdiction of Victorian courts.
